1. Acceptance of Terms

By accessing or using the STEM Ninja application, website, or any related services (collectively, thePlatform), you agree to be bound by these Terms of Use (Terms). If you do not agree, you must not use the Platform.

If you are under 18 years of age, you must obtain consent from a parent or guardian before creating an account or using the Platform. Parents and guardians are responsible for supervising their child’s use of the Platform and ensuring compliance with these Terms.

2. Purpose and Scope

STEM Ninja provides an online learning environment for students to practise subject‑based questions aligned with the NSW HSC curriculum; receive AI‑assisted feedback on multiple choice and short‑answer questions; track progress through analytics and dashboards; and participate in community discussions, where available. The Platform is designed for educational purposes only and does not replace formal tutoring or classroom instruction.

3. Accounts and Eligibility

• To access most features, you must create an account.
• You agree to provide accurate, current, and complete information when registering.
• Accounts are personal and may not be shared.
• We reserve the right to suspend or terminate any account that violates these Terms.
• Parents/guardians may request access to their child’s account information.

4. Service Tiers and Payments

STEM Ninja offers multiple subscription tiers:

• Free Tier – limited access to questions and basic analytics.
• Digital Tier – paid access to full digital functionality.
• Premium Tier – digital access plus group tutoring sessions (via Zoom or similar).

All prices are in Australian dollars (AUD) and inclusive of GST unless otherwise stated. Payments are processed through secure third‑party providers. Subscriptions renew automatically unless cancelled prior to the renewal date. Refunds are handled in accordance with Australian Consumer Law.

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful or inappropriate purpose;
• Upload, post, or share offensive, harmful, or misleading content;
• Interfere with or attempt to disrupt the Platform’s functionality;
• Share another person’s personal information without consent;
• Use automated systems to access, collect, or extract data from the Platform.

STEM Ninja reserves the right to remove content, suspend accounts, or restrict access where conduct breaches these Terms or community standards.

6. Educational Content and AI Functionality

AI‑generated feedback is intended to support learning and is not guaranteed to be accurate or exhaustive. While STEM Ninja uses retrieval‑augmented generation (RAG) and other AI technologies, the results may vary and should not be relied upon as definitive academic or professional advice. We recommend that students verify information with qualified teachers or tutors.

7. Community Features

• You must engage respectfully and constructively.
• STEM Ninja and its tutors may endorse or moderate posts, but we are not responsible for user‑generated content.
• Any bullying, harassment, or inappropriate behaviour will result in suspension or termination.

8. Intellectual Property

All intellectual property on the Platform—including questions, modules, software, AI prompts, feedback systems, designs, logos, and trademarks—is owned or licensed by STEM Ninja Pty Ltd. You are granted a limited, non‑exclusive, non‑transferable licence to use the Platform for personal educational purposes only. You may not reproduce, distribute, or create derivative works without prior written consent.

9. Data, Analytics, and Performance Tracking

The Platform tracks user activity, including question responses, performance data, and progress metrics, to deliver feedback and improve learning outcomes. Aggregated and anonymised data may be used to improve the Platform or produce insights. See our Privacy Policy for full details on data collection and handling.

10. Availability and Maintenance

We aim to provide uninterrupted service but do not guarantee that the Platform will always be available or free from errors. We may update, suspend, or discontinue parts of the Platform for maintenance, upgrades, or any other reason, with or without notice.

11. Limitation of Liability

To the maximum extent permitted by law, STEM Ninja excludes all warranties, representations, and guarantees regarding the Platform, except as required by law; STEM Ninja will not be liable for any loss of data, profits, or indirect damages arising from use of the Platform; and your sole remedy for dissatisfaction is to stop using the Platform. Nothing in these Terms limits any rights you have under Australian Consumer Law.

12. Termination

We may suspend or terminate your account immediately if you breach these Terms. Upon termination, all rights granted to you will cease. Provisions concerning intellectual property, disclaimers, limitation of liability, and governing law will survive termination.

13. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated through the Platform or by email. Continued use of the Platform constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you agree to submit to the non‑exclusive jurisdiction of the courts of that state.
